The Misuse of Drugs Act 1981 (WA) applies to a wide range of drugs, including illicit and illegal drugs, as well as he abuse of prescription and over-the-counter drugs.

There are a number of offence categories associated with drugs under which you may be charged. These include::

  • Possession of
  • Sell or Supply (Actual, or intent to);
  • Trafficking.

The severity of a charge and associated penalties depends on two factors:

  1. The type of prohibited drug in your possession; and
  2. The actual quantity of that prohibited drug.

Certain low-level offences may give rise to an opportunity to have your matter dealt with or addressed by way of treatment or counselling programs initiated and entered through a specialist Drug Court magistrate. An accused's eligibility for having their matter heard in Drug Court depends on the nature, number and severity of the charges being brought.
