Frequently Asked Questions

01
When Should I Instruct a Personal Injury Lawyer?

We recommend you seek legal advice as soon as possible after your accident and have made a claim so that our team of experienced Injury Lawyers can help you to achieve the maximum amount of compensation for your claim.

Even if your claim has been running for a while we can still assist with taking over your claim and fighting for your legal rights and entitlements. We know the claim is important to you and that passing it on may be a difficult task.

02
What Happens at the Initial Appointment? What Will it Cost?

We offer a free no-obligation appointment for all new personal injury enquiries.  We meet with you to discuss the accident circumstances and the effect that the accident has had on your life. We also review your documentation and provide you with the following initial information:

  • Advice on your compensation claim and your legal rights and entitlements.
  • A preliminary estimate of the compensation you may receive for your claim.
  • How long it will take to settle your claim
  • The legal fees involved for us to assist you with your claim
  • The next steps to take to progress your claim

We work with you to explain the claims process in an easy to understand way so that you can make an informed decision before deciding to instruct us.

03
I Have Been Made a Settlement Offer But I Don’t Think It’s Fair. Can You Help Me with Settlement of My Claim?

We can of course assist you with settlement of your claim and we understand that money cannot change what you have been through.

We will fight to achieve the maximum award of compensation for you.

04
I Can’t Attend Your Offices - Can You Still Help me?

You don’t need to personally attend our offices for the initial appointment. Many of our clients do not live in the metropolitan region of Perth or are still in hospital or recovering at home.  We can arrange for home visits or teleconferences to suit your needs. We make it as easy as possible for you to obtain legal advice with respect to your claim.

05
What Will It Cost? What Are Your Legal Fees?

You will not have to pay any legal costs while your claim is running and all of your legal costs will be paid at the conclusion of the claim when you receive your lump sum payment.

We will pay for all medical report fees and any other disbursements (such as court fees) that need to be paid while the claim is running.

At the conclusion of the claim, the insurer (in addition to paying you lump sum payment of compensation/damages to finalise the claim) will make a reasonable contribution towards payment of your legal costs however they are not required to pay for all of your legal costs and there is always a “gap fee” that is payable by the client. The gap fee is the difference between what the insurer pays (party to party costs) and what your legal costs are (solicitor to client costs).

We ensure that any “gap fee” is reasonable and proportionate to your lump sum payment of compensation.  Of course you are also charged for legal work performed and we provide you with an itemised invoice at the conclusion of your claim. We are open and transparent about your legal fees and we appreciate that this a very important factor when considering instructing a lawyer to assist with your claim.
